In short: you may use NAPOLEON for your own personal trips. What you create is yours. The App helps you organize rides — it does not navigate, and you are always responsible for riding safely and legally.
1. Acceptance
These Terms of Use (“Terms”) govern your use of the iOS app NAPOLEON — Ride & Rest (the “App”), provided by NAPOLEON, Via Giuseppe Mazzini 44, 10059 Susa (TO), Italy (“we”, “us”). By downloading or using the App you agree to these Terms. If you do not agree, please do not use the App.
2. The App
The App is an offline trip organizer for motorcyclists and cyclists. It lets you plan rides by days and stops, use a ride checklist, keep a travel journal with photos, record vehicles and service records, and view ride statistics. NAPOLEON is an independent app; it is not affiliated with any similarly named brand and has nothing to do with gambling.
3. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices that you own or control, for your own non-commercial purposes, in accordance with these Terms and the Apple Media Services Terms and Conditions. You may not copy, modify, distribute, sell, rent, reverse engineer or create derivative works of the App, except as permitted by applicable law.
4. Your content
Everything you create in the App — rides, stops, checklists, journal entries, photos, vehicles and service records — belongs to you. We claim no rights over it, and because it is stored only on your device we do not receive it. You are responsible for keeping your own backups and for having the rights to any photos you add.
6. Acceptable use
You agree not to use the App in any way that is unlawful or that could damage, disable or impair the App.
7. Provided “as is”
To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee that the App will be error-free or uninterrupted, or that data stored on your device will never be lost. Nothing in these Terms limits any rights you have as a consumer under mandatory law, including legal guarantees of conformity.
8. Limitation of liability
To the extent permitted by applicable law, we are not liable for indirect or consequential damages, loss of data or loss arising from your use of the App or from decisions made while riding. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or gross negligence, or any other liability that cannot be excluded under Italian or EU law.
9. Apple terms
The App is distributed through Apple's App Store. Apple's Licensed Application End User License Agreement (EULA) applies to your use of the App, together with these Terms. If there is a conflict, these Terms apply to the extent permitted by the Apple EULA. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support for it.
10. Governing law
These Terms are governed by the laws of Italy. If you are a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of your place of residence as provided by applicable law.
11. Changes
We may update these Terms from time to time. The current version is always available on this page with its date. Continued use of the App after an update means you accept the revised Terms.
